These Terms of Service (“Terms”) govern your use of the Hey Benson™ website, mobile apps, and related services (“Service”), operated by InstaEvent Inc. By accessing or using the Service, you agree to these Terms in full. If you do not agree, you must not use Hey Benson.

This website uses cookies. By using the Service, you consent to our use of cookies in accordance with our Privacy Policy.

We reserve the right to update these Terms from time to time. Updates will be posted on this page with a new effective date.

License to Use the Service

Unless otherwise stated, InstaEvent and/or its licensors own the intellectual property rights in the Service and all content. Subject to the license below, all these rights are reserved.

You may view, download for caching, and print pages from the website for personal use, subject to the restrictions set out in these Terms.

Acceptable Use

You must not use the Service in any way that:

• Causes or may cause damage or impairment of availability or accessibility,
• Is unlawful, illegal, fraudulent, or harmful,
• Involves malware, spyware, Trojan horses, or similar harmful software,
• Involves systematic or automated data collection (scraping, data mining, etc.) without InstaEvent's express written consent,
• Involves transmitting or sending unsolicited commercial communications,
• Relates to marketing without InstaEvent's express written consent.

Restricted Access

We reserve the right to restrict access to certain areas of the Service, or the entire Service, at our discretion. If we provide you with a user ID and password, you must keep them confidential. We may disable your account at our discretion without notice or explanation.

AI Assistant and Recommendations

Hey Benson uses artificial intelligence to provide event suggestions and coordination. By using the Service, you acknowledge that:

• AI-generated suggestions may not always be accurate, complete, or appropriate,
• Recommendations are informational only and not professional advice,
• You remain responsible for the decisions you make,
• Conversations may be processed by trusted third-party providers as described in our Privacy Policy.

User Content

“User Content” means material you submit to the Service (text, images, audio, video, event details, etc.).

Your User Content must not be illegal, infringing, or harmful. You must not submit content subject to threatened or actual legal proceedings.

By submitting User Content, you grant InstaEvent a worldwide, non-exclusive license to use, reproduce, and distribute it solely to operate the Service.

We reserve the right to remove or edit User Content that violates these Terms.

SMS and Notifications

By providing your mobile number and opting in to SMS communications, you consent to receive messages from InstaEvent, including event invitations, reminders, and one-time passcodes (OTPs).

• Standard message and data rates may apply
• You may opt out at any time by replying “STOP” or following instructions in a message
• After opting out, you may still receive essential account or legal messages
• SMS services may not be available on all carriers or devices

We respect your privacy. SMS data is used in accordance with our Privacy Policy.

Intellectual Property

All intellectual property rights in the Service belong to InstaEvent Inc. You may not reproduce, distribute, or create derivative works without prior written consent.

No Warranties

The Service is provided “as is” and “as available.” InstaEvent makes no warranties, express or implied, regarding the accuracy, reliability, or availability of its services.

Limitations of Liability

To the fullest extent permitted by law, InstaEvent will not be liable for:

• Indirect, special, or consequential losses,
• Business losses, revenue, profits, contracts, goodwill, or data,
• Losses caused by reliance on AI-generated suggestions.

These limitations apply even if InstaEvent has been advised of potential loss.

Exceptions

Nothing in these Terms will exclude or limit:

• Liability for death or personal injury caused by negligence,
• Liability for fraud or fraudulent misrepresentation,
• Any matter where liability cannot be excluded under law.

Reasonableness

By using the Service, you agree that the limitations of liability in these Terms are reasonable. If you do not agree, you must not use the Service.

Other Parties

You accept that, as a limited liability entity, InstaEvent has an interest in limiting the personal liability of its officers and employees. You agree not to bring claims personally against officers or employees regarding losses in connection with the Service.

Indemnity

You agree to indemnify InstaEvent and its officers, employees, and partners against any losses, damages, costs, or expenses arising from your breach of these Terms or related claims.

Breaches of These Terms

If you breach these Terms, InstaEvent may take appropriate action, including:

• Suspending your access,
• Prohibiting access,
• Blocking IP addresses,
• Contacting your ISP,
• Taking legal action.

Variation

InstaEvent reserves the right to revise these Terms at any time. Revised Terms apply from the date of publication on this website.

Assignment

InstaEvent may transfer, sub-contract, or otherwise deal with its rights and obligations under these Terms without notifying you or obtaining consent. You may not transfer your rights or obligations without InstaEvent's prior written consent.

Severability

If any provision of these Terms is unlawful or unenforceable, the other provisions will remain in effect. If a provision could be lawful or enforceable if part of it were deleted, that part will be deemed deleted.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and InstaEvent regarding your use of the Service.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be subject to the exclusive jurisdiction of the courts of the State of Delaware.
