
These Terms govern your use of Hey Benson, including AI planning, events, invitations, messaging, credits, subscriptions, and in-app purchases.

These Terms and Conditions ("Terms") govern your access to and use of the Hey Benson website, mobile applications, AI planning tools, event coordination features, invitations, messaging, credits, subscriptions, and related services (collectively, the "Service"). The Service is operated by InstaEvent Inc. d/b/a Hey Benson ("InstaEvent," "Hey Benson," "Benson," "we," "us," or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect information.
You must be at least 18 years old to use Hey Benson. By using the Service, you represent that you are at least 18 and have the legal authority to agree to these Terms.
You may not use the Service if you are prohibited from doing so under applicable law or if we previously suspended or terminated your account for violating these Terms.
You may need an account to use certain features. You agree to provide accurate, current, and complete information and to keep your account information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you believe your account has been accessed without authorization.
We may suspend, restrict, or terminate your account if we believe your account has been compromised, used fraudulently, or used in violation of these Terms.
Hey Benson is an AI-powered social coordination service. It helps users create events, invite guests, coordinate plans, send reminders, collect RSVPs, suggest places or activities, generate event-related content, and use credits for eligible AI-powered or premium features.
The Service may include free features, paid features, credits, subscriptions, in-app purchases, AI-generated content, invitations, event chat, group coordination, reminders, recommendations, and third-party integrations.
We may add, remove, suspend, limit, or modify features at any time, subject to applicable law and app-store requirements.
Hey Benson may offer credits, subscriptions, credit packages, add-ons, or paid digital features. Credits may be used for eligible features such as AI planning, premium event tools, image generation, larger group coordination, advanced reminders, or other functionality shown in the app.
The number of credits required for a feature may vary based on the feature, usage level, event size, AI processing, image generation, or other factors shown in the app. We may change credit prices, credit packages, included features, or credit usage rates on a going-forward basis.
Credits have no cash value, are not legal tender, are not your personal property, are non-transferable, and may not be sold, traded, assigned, or redeemed for money except where required by law.
Purchased credits do not expire while your account remains active, except where expiration, forfeiture, or removal is permitted or required by applicable law, app-store rules, fraud prevention, chargeback handling, or these Terms. Free, trial, bonus, promotional, or courtesy credits may expire, be limited, or be removed at any time unless prohibited by law.
We may deduct credits when a feature is used, requested, generated, processed, delivered, or otherwise consumed. Failed, incomplete, or cancelled actions may not always result in credit restoration, depending on the feature, cost incurred, and circumstances.
If you purchase credits, subscriptions, or other digital features inside the iOS app or Android app, the purchase may be processed by Apple through In-App Purchase or by Google through Google Play Billing, as applicable.
Apple and Google may apply their own terms, payment rules, taxes, refund rules, cancellation processes, subscription management tools, and account requirements. Your app-store account may be charged at confirmation of purchase.
We do not receive or store your full credit card number, debit card number, bank account number, CVV, Apple ID password, Google password, or full payment credentials.
We may receive transaction IDs, purchase tokens, receipts, product IDs, subscription IDs, purchase dates, renewal status, refund status, chargeback status, and related purchase information to validate purchases, add credits, restore purchases, provide support, prevent fraud, and comply with tax, accounting, legal, and app-store obligations.
Refunds for purchases made through Apple or Google are generally handled by Apple or Google under their policies. We do not control whether Apple or Google approves a refund. If a purchase is refunded, reversed, charged back, or found to be fraudulent, we may remove the related credits, suspend access to paid features, or adjust your account balance.
Where applicable, you are responsible for managing subscriptions, renewals, cancellations, and payment methods through your Apple App Store account or Google Play account. Deleting the app does not automatically cancel a subscription.
We will provide a restore mechanism for eligible restorable in-app purchases where required by Apple, Google, or applicable law.
We may offer free credits, trials, beta access, discounted packages, promotional features, or limited-time offers. We may modify or end these offers at any time unless otherwise stated or required by law.
Promotional credits may be subject to limits, expiration, eligibility rules, abuse controls, and feature restrictions.
Hey Benson may send service-related messages, including event invitations, reminders, RSVP notices, event updates, cancellations, one-time passcodes, security alerts, support messages, and account notices.
By providing a phone number, email address, or contact information and using invitation or notification features, you authorize us to send service-related communications to you or to the invitees you select.
If you invite another person, you represent that you have the right to provide their contact information for the invitation and that the invitation is not abusive, fraudulent, unlawful, or spam.
SMS message frequency may vary. Message and data rates may apply. You may opt out of eligible SMS messages by replying STOP and may request help by replying HELP where available. Opting out of some messages may limit Service functionality.
Hey Benson uses artificial intelligence to understand planning intent, recommend venues or activities, generate event content, summarize planning context, automate coordination, and assist with invitations, reminders, and follow-up.
AI-generated information may be inaccurate, incomplete, outdated, unsafe, unavailable, or inappropriate. You are responsible for verifying event details, venue information, hours, addresses, pricing, accessibility, availability, directions, reservations, and other real-world details before relying on them.
Hey Benson does not provide legal, medical, financial, safety, transportation, emergency, or professional advice. Do not rely on Benson for emergencies or urgent safety decisions.
You remain responsible for decisions you make, actions you take, events you create, people you invite, messages you send, and places you choose.
"User Content" means content you submit, upload, send, create, or make available through the Service, including text, messages, photos, event details, images, preferences, RSVPs, comments, prompts, and feedback.
You retain ownership of your User Content. By submitting User Content, you grant InstaEvent a worldwide, non-exclusive, royalty-free license to host, use, copy, process, display, transmit, modify, and create derivative works from that User Content solely as needed to operate, improve, secure, support, and provide the Service.
You represent that you have all rights needed to submit User Content and that your User Content does not violate law, infringe third-party rights, invade privacy, or violate these Terms.
We may remove, restrict, or refuse User Content that violates these Terms or creates legal, safety, operational, or reputational risk.
You agree not to use the Service to:
The Service may reference, link to, or integrate with third-party services, including Apple, Google, maps, places, restaurants, venues, reservation platforms, ticketing providers, messaging providers, email providers, payment processors, weather providers, analytics tools, and AI providers.
Third-party services are controlled by their own operators and may be subject to separate terms, privacy policies, prices, fees, availability, cancellation rules, and refund rules.
We are not responsible for third-party venues, reservations, services, transportation, food, events, prices, hours, safety, accessibility, cancellations, or customer service. Any dispute with a third party is between you and that third party.
Hey Benson may receive referral fees, commissions, sponsorships, or other compensation from certain third-party partners when users interact with recommendations, bookings, or offers. Sponsored or paid placements will be labeled where required by law or platform policy.
The Service, including the Hey Benson name, logos, software, design, text, graphics, features, interfaces, workflows, AI coordination logic, and other content, is owned by InstaEvent or its licensors and is protected by intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose and in accordance with these Terms.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Service except as allowed by law or with our written permission.
If you provide ideas, suggestions, bug reports, feedback, or recommendations, you grant us the right to use them without restriction or compensation to you.
Our collection, use, disclosure, and retention of information is described in our Privacy Policy. By using the Service, you acknowledge our Privacy Policy.
The Service may be interrupted, delayed, unavailable, inaccurate, or changed. We may update, modify, suspend, or discontinue all or part of the Service at any time.
We are not responsible for outages, delays, errors, lost messages, missed reminders, failed notifications, unavailable AI providers, unavailable app stores, third-party service failures, or internet or carrier issues.
You may stop using the Service at any time. You may request account deletion by contacting us or using available account tools.
We may suspend or terminate your access to the Service if we believe you violated these Terms, created risk, caused harm, abused the Service, engaged in fraud, violated app-store rules, or used the Service unlawfully.
If your account is terminated for breach, fraud, chargeback abuse, or unlawful conduct, you may lose access to free, promotional, or bonus credits. Purchased credits will be handled according to applicable law, app-store rules, and these Terms.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and error- free operation.
We do not guarantee that events will happen, invitees will attend, users will respond, messages will be delivered, venues will be available, recommendations will be correct, or AI outputs will meet your expectations.
To the fullest extent permitted by law, InstaEvent and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost- profit damages, including loss of data, loss of goodwill, lost revenue, event losses, missed plans, failed invitations, or reliance on AI-generated information.
To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid to Hey Benson for the Service in the three months before the claim or one hundred U.S. dollars.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
You agree to defend, indemnify, and hold harmless InstaEvent and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your User Content, your events, your invitations, your violation of these Terms, your violation of law, your misuse of credits or purchases, or your violation of third-party rights.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to applicable law, disputes will be brought in the state or federal courts located in San Diego County, California.
We may update these Terms from time to time. If changes are material, we may notify you by email, in-app notice, website notice, SMS, or another reasonable method. Updated Terms are effective when posted unless a different effective date is stated.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
